Please read these Terms of Service (“Terms,” “Agreement”) carefully before using www.m-bodypilates.com (the “Site”) operated by M-Body Pilates LLC (“M-Body,” “we,” “us,” or “our”). By accessing or using our Site, you agree to be bound by these Terms and all applicable laws. If you do not agree, you should discontinue use of the Site immediately.
1. Accounts
To access certain Site features, you may need to create an account. You must:
- Provide accurate, current, and complete information.
- Keep your login credentials confidential.
- Notify us immediately of any unauthorized use of your account.
M-Body Pilates is not responsible for any losses arising from failure to maintain the security of your account.
2. Member Services and Policies
Cancellations
Reformer classes must be cancelled at least 4 hours before the scheduled start time. Waitlisted clients who are added to class will be expected to attend unless they cancel within the same window.
Reservations
You must be physically present at the start of class, or your spot may be released to a waitlisted participant.
Membership Packages
Members with Unlimited Monthly packages may incur a penalty fee for late cancellations or no-shows.
Personal Belongings
M-Body Pilates is not responsible for lost, stolen, or damaged personal items. You assume all risk for belongings brought into the studio.
Free Classes
Free or promotional classes are subject to the same cancellation and no-show policies as paid classes. Failure to attend will result in the charge of a single-class rate.
3. Studio Rules and Regulations
- All classes and memberships are non-refundable.
- All sessions must be prepaid prior to attendance.
- Reserved classes must be changed or cancelled at least 4 hours prior to the scheduled time.
- Members who miss class or cancel late will forfeit the session or incur a penalty fee.
- Notify your instructor of any illness, injury, or medical concern before class begins.
- Instructors and schedules may change without notice; please check your online account for current availability.
- Payment methods accepted: Cash, Visa, MasterCard, Discover, and American Express.
4. Limitation of Liability
By enrolling online, attending classes, or participating in any M-Body Pilates program (in-studio, virtual, or otherwise), you agree to the following:
You confirm you are in good physical health and capable of safely participating in Pilates and related exercise activities. You understand that participation involves inherent risks, including but not limited to injury, illness, abnormal blood pressure, fainting, heart attack, or death. You voluntarily assume all such risks and release M-Body Pilates LLC, its owners, instructors, contractors, and employees from any liability, claims, or damages that may arise from participation.
If you are pregnant, recovering from injury, or managing a medical condition, consult your physician before participating. Minors aged 13–17 may attend only with a parent or legal guardian present; participants under 13 are not permitted.
COVID-19 Notice
While M-Body Pilates maintains reasonable preventive measures, we cannot guarantee that you will not be exposed to COVID-19 or other illnesses. By entering the studio or participating in programs, you voluntarily assume this risk.
M-Body Pilates reserves the right to deny participation to anyone whose health may be at risk or who fails to follow studio policies or instructor direction. Instructor advice should never be interpreted as medical advice.
5. Intellectual Property and Content
All text, images, graphics, videos, logos, trademarks, and other materials on this Site (“Content”) are the property of M-Body Pilates LLC or its licensors and are protected by copyright and trademark law.
You may view and use Site Content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or exploit any material from the Site without prior written consent from M-Body Pilates.
Any suggestions, ideas, or feedback you provide become the sole property of M-Body Pilates and may be used without compensation or obligation to you.
6. Mobile Services
Certain services may be accessible via mobile devices, such as booking classes, receiving text reminders, or managing your account. Your carrier’s standard rates, data fees, and other charges apply. By using these services, you consent to receive electronic communications (SMS, MMS, or email) from M-Body Pilates regarding your account or class updates.
7. Termination
We may suspend or terminate your access to the Site or your membership at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all applicable provisions of this Agreement shall remain in effect.
8. Third-Party Links
Our Site may contain links to external websites not operated by M-Body Pilates. We are not responsible for the content, privacy policies, or practices of any third-party sites. We recommend reviewing their terms before engaging with them.
9. Fees and Payments
All pricing and fees for services are subject to change at any time. If M-Body Pilates terminates your membership for violation of these Terms, no refunds will be issued for unused sessions or portions of memberships.
10. Eligibility
You must be at least 13 years old to use the Site. Minors between 13 and 17 may register only with the involvement of a parent or guardian. Membership is void where prohibited by law.
11. Governing Law
These Terms shall be governed by and construed under the laws of Jefferson County, Texas, without regard to conflict of law principles.
12. Modifications to Terms
We may update or revise these Terms from time to time. The revised date will appear at the top of this page. Continued use of the Site after updates constitutes your acceptance of the revised Terms.
13. Entire Agreement and Severability
These Terms, along with our Privacy Policy, form the entire agreement between you and M-Body Pilates LLC. If any part of these Terms is deemed unenforceable, the remaining provisions shall continue in full force.
14. Arbitration
Any dispute arising from these Terms, the Site, or M-Body Pilates services shall be resolved by binding arbitration in Jefferson County, Texas, under the rules of the American Arbitration Association. Each party will bear its own costs. Injunctive relief may be sought where appropriate.
